South West Machinery ("we", "us", "our") is a UK-based supplier of heavy plant and construction machinery. By using our website or purchasing from us, you agree to be bound by these Terms and Conditions. Please read them carefully.
You may use our website for lawful purposes only. You must not use it in any way that causes or is likely to cause the site to be interrupted, damaged or impaired, or use it to transmit any unsolicited commercial communications. We reserve the right to suspend or withdraw access to our website at any time without notice.
All product descriptions, specifications and pricing on our website are provided in good faith and are subject to change without notice. Where prices are listed as "POA" (Price on Application), a formal quotation will be provided upon enquiry. We reserve the right to correct any errors in pricing or descriptions. Images are for illustrative purposes and may not exactly represent the product supplied.
A contract between you and South West Machinery is formed only when we issue a written order confirmation. Enquiries submitted via our website or by email do not constitute a binding order. We reserve the right to decline any order at our discretion.
Full payment is required before delivery or collection of goods unless otherwise agreed in writing. Payment can be made by bank transfer or other methods as agreed at the time of order. Ownership of goods does not pass to the buyer until full payment has been received and cleared.
Delivery timescales are estimates and are not guaranteed. South West Machinery shall not be liable for any loss arising from delays in delivery. Risk in the goods passes to the buyer upon delivery. It is the buyer's responsibility to ensure suitable arrangements are in place to receive delivery.
New machinery is supplied with the manufacturer's standard warranty. Used machinery is sold as seen unless a specific warranty is agreed in writing at the time of sale. Warranty claims must be made directly in accordance with the terms of the relevant manufacturer's warranty policy.
To the fullest extent permitted by law, South West Machinery shall not be liable for any indirect, consequential or incidental loss arising from the use or inability to use our products or services. Our total liability to you shall not exceed the value of the goods purchased from us.
These Terms and Conditions are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
